The accusation is that tanker was found open near the hut from which spirit was being drainage out by the petitioners and others. On the secret information when the police raided, the petitioners succeeded to flee away from there and the driver of the vehicle has disclosed the name of the petitioners as occupant. Learned counsel appearing on behalf of the petitioners submits that it would appear from the F.I.R. that the petitioners have not been arrested on the spot. Moreover, the hut near the tanker was said to be found is not belonged to the
Patna High Court Cr.Misc. No.43062 of 2014 (3) dt.27-03-2015 2/2 petitioners. It is also submitted that petitioners have been made accused in the case mere on suspicion.
Having considered the facts and circumstances of the case, in the event of arrest or surrender before the Court below within four weeks from the date of receipt/production of the copy of this order, the above named petitioners are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate, Ist Class, Sitamarhi, District - Sitamarhi in connection with Complaint Case No. C-2/14/2014, subject to the conditions as laid down under Section 438(2) of Cr. P.C.
