JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-03-2016 Petitioner being brother of the husband of the informant is apprehending his arrest in a case registered for the offences punishable under Section 498A of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act. The basic accusation is of torture for nonfulfilment of dowry demand. It is submitted by learned counsel for the petitioner that petitioner resides abroad and he came to India only on 20.01.2016 after the death of his father. A statement to that effect has been made in para 9 of the petition. The relevant portion of which reads as follows:- "..............that even the petitioner not residing in India and he only arrived here after death of his father who died on 20.01.2016"
Patna High Court Cr.Misc. No.12004 of 2016 (2) dt.11-03-2016 2/2 It is further submitted that thrust of accusation is against the husband of the informant who has filed Matrimonial Suit No. 95 of 2014 for the dissolution of marriage.
Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Nawada in connection with Nawada Town(Bundelkhand) P.S. Case No. 693 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) Shageer/- U T
