JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-03-2015 Learned counsel for the petitioners is permitted to make correction in paragraph no. 1 of the petition.
Heard learned counsels for the petitioners, complainant and learned A.P.P. for the State. The petitioners being the brothers of late husband of the complainant are apprehending their arrest in a complaint case in which processes have been directed to be issued after cognizance being taken for the offences punishable under Sections 498(A) of the Indian Penal Code and 4 of the D. P. Act.
It is specifically alleged by the
Patna High Court Cr.Misc. No.8693 of 2015 (2) dt.02-03-2015 2 / 3 complainant that she is not being allowed to enjoy her share in in-laws property.
It is submitted by learned counsel for the petitioners that the petitioners are ready to allow the complainant to enjoy her share in in-laws property.
Considering the aforesaid stand of the petitioners, let the petitioners, above named, be released on provisional anticipatory bail for one year, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today in connection with Complaint Case No. 158 of 2014 on furnishing bail bond of Rs.10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Nawada, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. The bail bonds of the petitioners will be accepted on filing affidavit by each of the petitioners that they will allow the complainant to enjoy her share in in-laws property. The said affidavit will be transmitted to the concerned police station where the in-laws property of the complainant is situated.
The provisional bail of the petitioners will be confirmed by the learned court below if the
Patna High Court Cr.Misc. No.8693 of 2015 (2) dt.02-03-2015 3 / 3 petitioners will comply the undertaking given before this Court.
