The petitioners apprehend their arrest in Muzaffarpur (Town) P.S. Case No. 39/2015, registered for the offences punishable under Section 420 and other sections of the Indian Penal Code.
The informant filed complaint case on the basis of which the present F.I.R. was lodged. The informant in his
Patna High Court Cr.Misc. No.10944 of 2016 (4) dt.28-03-2017 2/3 complaint petition stated that petitioners are Senior Marketing Manager and Office Assistant of Green Ray International Ltd., Muzaffarpur and stated that the said company deals in banking business which give 18 % interest on the money collected from people or give triple amount.
It is submitted that the informant was agent of the company. The informant had not stated any word against the petitioners and no money was received by the petitioners from the informant. The informant collected money from different persons, as he was agent of the company.
Learned counsel for the informant however, vehemently, opposed the prayer for anticipatory bail of the petitioners.
Considering the facts aforesaid and the fact that the informant in his complaint petition did not make any sorts of allegation against the petitioners, save and except the fact that the petitioners are named in the complaint petition as Senior Branch Manager and Office Assistant, the petitioners above-named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the
Patna High Court Cr.Misc. No.10944 of 2016 (4) dt.28-03-2017 3/3 like amount each to the satisfaction of Chief Judicial Magistrate, Muzaffarpur in connection with Muzaffarpur (Town) P.S. Case No. 39/2015, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
