JUSTICE SANDEEP KUMAR ORAL ORDER 11-09-2024 The petitioner apprehends his arrest in connection with Bypass P.S. Case No. 294 of 2020 registered for offences under Sections 120B, 420, 414, 467, 468 and 471 of the Indian Penal Code and Section 30(a) and 46(1) of the Bihar Prohibition and Excise Act.

2. As per the prosecution case, altogether 4815.180 liters of foreign illicit liquor has been recovered.

3. The name of the petitioner has come in the confessional statement of co-accused who was involved in the business of illicit liquor.

4. The petitioner has seven more cases registered against him out of which there are three cases of Excise Act. It appears that the petitioner is involved in the business of illicit liquor.

5. Considering facts of the case and the materials available on record, I am not inclined to grant anticipatory bail to the petitioner.

6. The application for anticipatory bail is, accordingly, rejected.

7. The petitioner is directed to surrender in the Court below within a period of one week from today as he is an absconder in a case of 2020.

8. If the petitioner doesn't surrender in the Court below within one week from today, the Superintendent of Police, Vaishali will take all steps for the arrest of the petitioner.

9. Mr. Jharkhandi Upadhyay, learned A.P.P. will communicate this order to the Superintendent of Police, Vaishali.

10. Let a copy of this order be communicated to the Superintendent of Police, Vaishali through FAX for its compliance forthwith.
