2. The petitioner is in judicial custody in connection with Buxar (Town) P.S. Case No. 563 of 2023 for the offence punishable under Sections 304(B) and 34 of the Indian Penal Code lodged on 10.10.2023 by the informant, Chhotak Ram.
3. Earlier, bail application of the petitioner was rejected in Cr. Misc. No. 31221 of 2024 on 30.08.2024 and this is the second attempt.
4. A report was called for from the Trial Court and the report dated 15.10.2025 shows that from 28.02.2024 to 09.10.2025 no prosecution witness has been produced.
5. As per the prosecution story, the petitioner was in relationship with the deceased and solemnized marriage but according to the allegation, he thereafter started torturing for the dowry and ultimately, she was killed. Accordingly the FIR.

The allegation is there, the petitioner is the main culprit as alleged, he is in custody since 11.10.2023, the Trial Court's report shows that not a single witness has been examined, an undertaking has been given that the petitioner shall be diligently appearing in trial, in that background, this Court is inclined to extend him the privilege of bail with conditions.
8. Let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of like amount each to the satisfaction of learned Additional District & Sessions Judge-III, Buxar, in connection with S.Tr. No. 01 of 2024 arising out of Buxar (Town) P.S. Case No. 563 of 2023 subject to the following conditions: (i) one of the bailor should be the family member/relative of the petitioner who shall provide official document to show his bona fide;
(ii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his bail bond by the Trial Court itself;
(iii) the petitioner shall appear before the concerned police station every fortnight for next six months to mark his

No.49448 of 2025(5) dt.12-12-2025 3/3 attendance and at the end of the period a certificate be submitted before the Trial Court failing which the State shall be at liberty to take steps for cancellation of bail bonds; (iv) the petitioner shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;
(v) the petitioner shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of his bail bonds.
9. Let the copy of the order be sent to the Superintendent of Police, Buxar alongwith the detailed chronological report sent by the Trial Court to show how the prosecution is defeating the trial by not producing a single witness from 28.02.2024 till 09.10.2025 when the last date has been recorded in this report.
10. Office to communicate the copy of the order to the S.P., Buxar for perusal and needful.
