JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 06-06-2018 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Deodha P.S. Case No. 16 of 2018 for the offences under Sections 272, 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
Learned counsel for the petitioner submits that the petitioner is in custody since 27.03.2018 and has remained in custody for more than 2 1⁄2 months. He further submits that the vehicle, from which the liquor was seized, does not belong to the petitioner. He further submits that nothing was recovered from the conscious possession of the petitioner.
Considering the fact that the petitioner has remained in custody for more than two and half months, the petitioner,
Patna High Court Cr.Misc. No.32590 of 2018 (2) dt.06-06-2018 2/2 named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge-cum-Special Judge, Excise Act, Madhubani in connection with Deodha P.S.
