The petitioner seeks bail in a case registered under Sections 447, 384, 379/34 of the Indian Penal Code and 17 of C.L.A. Act.
Allegedly, the accused persons forcibly stopped the repairing of road, assaulted the informant's driver and threatened that unless levy is paid, the work will not be allowed to continue.
It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 04-08-2018. Charge sheet has already been submitted. The petitioner has been falsely implicated in the present case. General and omnibus
Patna High Court CR. MISC. No.46988 of 2019(2) dt.30-07-2019 2/2 allegation has been made against the petitioner. The petitioner undertakes that he will cooperate in trial. The other co-accused with similar allegation has been granted bail by a coordinate bench of this court vide order dated 11-03-2019 passed in Cr. Misc. No. 78942 of 2018.
On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Gaya in connection with Paraiya P.S. Case No. 72 of 2016.
