JUSTICE PARTHA SARTHY ORAL ORDER 22-07-2021 Heard learned counsel for the petitioner and learned A.P.P for the State through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Choraut P.S. Case no. 66 of 2020 registered under sections 379 and 420 of the Indian Penal Code.
As per allegation in the F.I.R., it is stated that Ahilesh Yadav, the petitioner herein as also Sujit Kumar and one Rahul, while distributing soap to 800 persons took their Aadhar numbers and finger prints on wax. It is thereafter stated that privacy of 799 persons were stolen.
It is submitted by learned counsel for the petitioner that the allegations against the petitioner and others are false and concocted. The petitioner has been falsely implicated in the
Patna High Court CR. MISC. No.6653 of 2021(3) dt.22-07-2021 2/2 case. No soaps were ever distributed by the petitioner and there was no occasion for him to collect the Aadhar numbers or the finger prints on wax. There is no direct or indirect evidence to connect the withdrawal of money by the petitioner or the money having been transferred to the account of the petitioner. The petitioner is in custody since 9.10.2020 and has no criminal antecedent.
The application for bail is opposed by learned A.P.P. for the State.
Having heard learned counsel for the parties and taking into consideration the material that has transpired in course of investigation together with the investigation in the case having concluded, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Choraut P.S. Case no. 66 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Pupri, Sitamarhi.
