====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 03-09-2025 Heard learned counsel for the petitioners and learned APP for the State.

2. The petitioners seek regular bail in connection with Bodh Gaya P.S. Case No.306 of 2025, registered for the offences punishable under Sections 191(3), 190, 124(2), 115(2), 121(1), 132, 109, 352 of the B.N.S., 2023 and Section 37 of Bihar Prohibition and Excise Act.

3. As per the prosecution case, the allegation against the accused persons including the petitioners is of assaulting the police personnel by deadly weapons due to which the police sustained head injuries. It is also alleged that the petitioners along with other co-accused persons also caused hindrance in

Patna High Court CR. MISC. No.50146 of 2025(3) dt.03-09-2025 2/3 discharge of official duty under drunken condition.

4. Learned counsel for the petitioners submits that petitioners are innocent and have falsely been implicated in this case only on the basis of suspicion. He further submits that there is no specific or direct allegation of any overt act against the petitioners rather the same is general and omnibus in nature. Learned counsel submits that petitioners were only the member of the Barat party. He further submits that similarly situated coaccused persons have been granted regular bail by the Coordinate Bench of this Court vide orders dated 04.08.2025 passed in Cr. Misc. No.44500 of 2025 and 07.08.2025 passed in Cr. Misc. No.52030 of 2025. Petitioners are in custody since 30.05.2025 having no criminal antecedent. He further submits that there is no chance of absconding the petitioners or tampering with the evidence and the undertakes to cooperate in the investigation and trial.

5. Learned APP for the State has opposed the prayer for regular bail of the petitioners.

6. Considering the facts and circumstances of the case and the submissions of learned counsel for the parties, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two
