JUSTICE DINESH KUMAR SINGH ORAL ORDER 14-03-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 414/34 of the Indian Penal Code, 11(a), (b), (c), (d), (i), (n) and (k) of The Prevention of Cruelty to Animals Act, 1960, and rule 96 of the Transport of Animals Rules, 1978.

Prosecution case is that some cattle alleged to have been carried on Tata-407 vehicle without any paper suspected to be stole one when two persons were apprehended namely Ashraf and Md. Afroz, who disclosed the name of the owner of the vehicle as Deoraj Pandit. Though, subsequently it was found that the petitioner purchased the vehicle from Deoraj Pandit. It is submitted by learned counsel for the petitioner that admittedly the petitioner was not present at the place of seizure. The

Patna High Court Cr.Misc. No.10744 of 2016 (2) dt.14-03-2016 2/2 petitioner being simply owner of the public carrier has been roped in the present case. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Motihari, East Champaran in connection with Dumariyaghat P.S.
