The petitioner seeks anticipatory bail in connection with K.Hat P. S. Case No. 198 of 2018, registered for offences punishable under Sections 341,307/34 of the Indian Penal Code and subsequently Section 27 of Arms Act.
Allegation against the petitioner is of firing upon the informant with intention to kill, causing injury on the left thigh of the informant.
Submission of the learned counsel for the petitioner is that the injury is only on the thigh of the informant and there is a case and counter case between the parties.
Learned A.P.P. opposes he prayer for bail.
In view of the facts and circumstances discussed above
Patna High Court Cr.Misc. No.37129 of 2018 (3) dt.03-07-2018 2/2 and allegation against the petitioner is of firing, causing injury, as such, I am not inclined to grant bail to the petitioner. Accordingly, prayer for anticipatory bail is rejected with a direction to the petitioner that if the petitioner surrenders before the Court below and makes prayer for regular bail, which will be considered by the learned court below on its own merit without being prejudiced by order of this Court.
With the aforesaid observation, this application is dismissed.
