2. The petitioner seeks pre-arrest bail in connection with Khodawandpur Chhaurahi P.S.Case No..54 of 2023 registered for the offence punishable under Sections 304(B) and 201/34 of the Indian Penal Code.

3. As per the allegation made in the F.I.R., the petitioner along with other family members for non-fulfillment of demand of dowry has committed murder of the daughter of the informant.

4. Learned counsel appearing on behalf of the petitioners submitted that there is general and omnibus

Patna High Court CR. MISC. No.50421 of 2025(2) dt.11-08-2025 2/3 allegation against the petitioner. Petitioner is the elder brother of the husband of the deceased and he has no concern with the affairs of the deceased and her husband. Petitioner has clean antecedent.

5. Learned APP for the State has vehemently opposed the prayer for grant of pre-arrest bail to the petitioners.

Having considered the rival submissions made on behalf of the parties, as well as, the fact that there is general and omnibus allegation against the petitioner and the petitioner has clean antecedent, I am of the opinion that petitioner has, prima facie, made out a case that there is every likelihood of the petitioner to be acquitted, on the basis of the fact that the petitioner is elder brother of the husband of the deceased and he has no concern with affairs of the deceased and her husband.

7. The petitioner is directed to be released on prearrest bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Manjhaul, Begusarai in connection with Khodawandpur Chhaurahi P.S.Case No.54 of 2023, subject to the condition as laid down under Section 438(2) of the Cr.P.C.

8. The Court below is directed to verify the criminal antecedent of the petitioner, as stated in paragraph no. 3 of the bail application. If any other case is pending against the petitioner, as what has been stated in paragraph no. 3, this order will lose its force automatically.
