Petitioner is in custody in connection with Bakhtiarpur P.S. Case No. 164 of 2018, corresponding to Special Case No. 216 of 2018 for offenses punishable under sections 30(a) and 37(b) of Bihar Excise Act, 2016. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. He has further submitted that the allegation against the petitioner is that he has consumed liquor which is prohibited one, and the same was confirmed in breath analyzer test.

Considering the fact that there is a only allegation of consuming liquor against the petitioner and he has remained in the custody since 27.04.2018 having no criminal antecedent, let

Patna High Court Cr.Misc. No.32355 of 2018(2) dt.05-06-2018 2/2 the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Special Excise Judge, Saharsa, in connection with Bakhtiarpur P.S. Case No. 164 of 2018 and Special Case No. 216 of 2018.
