JUSTICE ASHUTOSH KUMAR ORAL ORDER 23-05-2022 Heard learned Advocate for the petitioner and learned Additional Public Prosecutor representing the State. The petitioner seeks bail in connection with Special Case No. 2294 of 2020 arising out of Khajekalan P.S. Case No. 98 of 2020 dated 05.03.2020 instituted for the offences under Sections 30(a) of the Bihar Prohibition and Excise Act, 2018. From the houses of Devendra Rai and one Mr. Mahto, 146.670 and 159.990 liters of liquor have been recovered. Aforesaid Devendra Rai is said to have confessed before the police that the petitioner is also involved in the trade. Merely on the basis of the aforesaid confession, the petitioner has been arrested and is in custody since 07.06.2021. Though the petitioner has been made accused in cases of similar nature in the past but, in all such cases, he has been

Considering the nature of accusation against him and the period of custody, the petitioner is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge (Excise), Patna in connection with Special Case No. 2294 of 2020 arising out of Khajekalan P.S. Case No. 98 of 2020.
