Ms. Nirmala Kumari, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 31-07-2025 Heard learned counsel appearing on behalf of the petitioners and learned A.P.P. appearing on behalf of the State.
2. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 221, 262, 263, 132, 303(2), 317(2), 317(4), 317(5) and 111 of the B.N.S..
3. As per prosecution case, informant, namely Narendra Kumar Prasad, S.I. of Police, alleged that all the F.I.R. named accused persons, including these petitioners, forcibly got released two accused persons from the police custody.
4. It is submitted by learned counsel appearing on behalf of the petitioners that petitioners are quite innocent and
Patna High Court CR. MISC. No.49024 of 2025(2) dt.31-07-2025 2/2 have committed no offence. Petitioners have falsely been implicated in this case merely on suspicion. Petitioners claim clean antecedents.
5. On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioners and submitted that petitioners are named in the F.I.R. with specific accusation that they, along with other accused persons, got two accused persons forcibly released from police custody.
6. Considering the facts and circumstances of the case and nature of accusation, the prayer for grant of anticipatory bail to the petitioners is rejected.
