The petitioner seeks regular bail in connection with Alauli P.S. Case No. 368 of 2017 corresponding to S.T. No. 86 of 2018 for the offences punishable under Section(s) 302, 120(B), 376(G)/34 of the Indian Penal Code.
The allegation is that the accused persons named in the written report attacked the wife and daughters of the informant while the wife and one daughter of the informant ran away. The accused person, however caught Punam Devi and cut her throat. The learned counsel for the petitioner submits that the petitioner is not named in the written report and his name has transpired upon confessional statement made by co-accused persons during the course of the investigation. Patna High Court Cr.Misc. No.32024 of 2018 (2) dt.24-05-2018 2/2 submitted that similarly situated co-accused have already been granted bail by this Court by an order dated 26.04.2018 passed in Cr. Misc. No.24023 of 2018. It is further submitted that the petitioner has a clean antecedent and is languishing in custody since 19.11.2017.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (rupees Ten thousand) with two sureties of the like amount each to the satisfaction of learned District & Session Judge, Khagaria in connection with Alauli P.S. Case No. 368 of 2017 corresponding to S.T. No. 86 of 2018. (Mohit Kumar Shah, J) Sanjeev/- U T
