JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 19-07-2019 Heard learned counsel for the petitioner, learned counsel for the Bihar School Examination Board and learned counsel appearing on behalf of the respondent State. The petitioner is aggrieved by the action of the respondent Bihar School Examination Board.

Learned counsel for the petitioner would submit that the similar issue came to this Court and on the stand taken by the respondent Examination Board that corrective measures would be taken by the Examination Board the writ petition was disposed of on the understanding that the respondent Examination Board take corrective measures.

Learned counsel for the petitioner would submit that

Patna High Court CWJC No.14434 of 2019(2) dt.19-07-2019 2/2 the case of the petitioner is similar to the case of Dharmendra Singh Yadav Vs. The State of Bihar & Ors. In C.W.J.C. No. 13691 of 2019, and the case of Tina Rai Vs. The State of Bihar & Ors. In C.W.J.C. No. 4239 of 2019.

Without expressing any opinion in the merit of the claim of the petitioner, the writ petition is disposed of with a direction to the Examination Board to consider the case of the petitioners in light of the case of Dharmendra Singh Yadav and Tina Rai mentioned above and if the case of the present petitioner is found similar, then same treatment may be extended to this petitioner also.

In view of the above, the present writ application is disposed of.
