The petitioner apprehends his arrest in connection with Ballia P.S. Case No. 105 of 2021 registered under Section 30(a) of the Bihar Prohibition and Excise Act. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Nothing has been recovered from the possession of this petitioner. The illicit liquor has been recovered from the wheat agriculture field of Md. Ajam and two magic vehicles, but neither the agriculture field nor the alleged vehicles belong to the petitioner. Further he submits that petitioner has no criminal antecedent.

Having considered the facts and circumstances of the

Patna High Court CR. MISC. No.60179 of 2021(2) dt.15-04-2022 2/2 case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of the Special Judge, Excise Act, Begusarai in connection with Ballia P.S. Case No. 105 of 2021, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
