JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-03-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 323, 324, 307, 379, 341 and 504/34 of the Indian Penal Code.

It is alleged that petitioner no.1 Ramashray Giri has caused injury with 'garasa' to the informant whereas it is alleged that petitioner no.2, Uma Devi committed theft of Rs.1000/-.

It is submitted by learned counsel for the petitioners that the injury has not been found to be grievous though the said injury has been found simple in nature. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent. Considering the nature of accusation, the prayer for bail on behalf of petitioner no. 1 Ramashray Giri is hereby rejected. So far as petitioner no.2 Uma Devi is concerned there is no specific accusation against her.

No.11855 of 2015 (2) dt.24-03-2015 2/2 Considering the above and she being a lady, let she be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Turkaulia P.S. Case No.768 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
