Petitioner apprehends his arrest in Sherghati (Dobhi) P.S. case no. 601 of 2017 instituted for the offence under Section(s) 341, 328, 120(B), 365 and 511/34 of the Indian Penal Code. In the written report, it is alleged that brother of the informant told him that petitioner has given some injection to him on account ofwhich he felt restless and became unconscious. Petitioner managed to run away from the place of occurrence. The three other accused persons, named in the F.I.R., were apprehended.
Case diary has been received. The statement of the victim has been recorded in para 26 of the case diary wherein he has fully supported the case and levelled specific allegation against
Patna High Court Cr.Misc. No.33437 of 2018(5) dt.12-07-2018 2/2 this petitioner of giving injection to him. The Medical report of the victim is available in para 31 of the case diary wherein the Doctor has found the victim unconscious, pulse feeble and his B.P. not recordable.
Therefore, this Court is not inclined to grant anticipatory bail to the petitioner. Prayer for anticipatory bail of the petitioner stands rejected.
Petitioner may surrender before the Court below and make prayer for regular bail which shall be considered and disposed of on its own merit in accordance with law without being prejudiced by the present order.
