Petitioner seeks bail in a case registered for the offences punishable under Section 414 of the Indian Penal Code. A stolen motorcycle was allegedly recovered from possession of the petitioner.
Submission is that petitioner has got no criminal antecedent and he is in custody since 07.04.2018. Investigation of the case is already complete. Further submission is that, in fact, for dispute relating to payment of remaining cost of the motorcycle, false case was lodged after 15 days of the alleged occurrence of theft of motorcycle.
Considering the entire facts aforesaid, let the petitioner, above named, be released on bail on completion of
Patna High Court Cr.Misc. No.34678 of 2018 (2) dt.18-06-2018 2/2 four months of custody on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with CRI Case No. 616/18 arising out of Town P.S. Case No. 104 of 2018, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
