The petitioner is languishing in custody in a case registered for the offences punishable under Section 392 of the Indian Penal Code.
It is alleged against the petitioner that he along with other co-accused persons have committed robbery of Rs. 80,000/- and mobile phone from the informant on gun point.
It is submitted by learned counsel for the
Patna High Court CR. MISC. No.56555 of 2023(2) dt.13-09-2023 2/3 petitioner that petitioner is innocent and he has falsely been implicated in this case. The petitioner is not named in the F.I.R and during investigation, only on the basis of suspicion, the petitioner has been roped in the present case. Nothing has been recovered from the conscious possession of the petitioner. The petitioner was arrested in Salaiya P.S Case No. 47 of 2021 and on the basis of self confession of the petitioner, the petitioner has been roped in the present case. The petitioner has still not been put on T.I.P. The petitioner was remanded in this case on 14.03.2023 and since then he is in custody. In contra, learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.
Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st
