The present Criminal Miscellaneous Application has been filed under Section 482 of The Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as "BNSS, 2023") for grant of anticipatory bail to the petitioners who apprehend their arrest in connection with Gopalganj Town P.S. Case No. 797 of 2024, for the offences punishable under Sections 126(2), 115(2), 118(1), 109, 352/ 3(5) of the BNS, 2023.

3. As per the prosecution, FIR has been lodged against the present petitioners against whom there is allegation that when the informant was constructing the cow shed in the meantime, accused persons reached there and assaulted the informant and his father due to which injury has been caused.
4. Learned Counsel for the petitioners submits that the petitioners are innocent and have committed no offence. Counsel also submits that the petitioners have been falsely implicated in the present case. He further submits that there is no allegation of act or overt act against the petitioners.
5. Counsel submits that the criminal antecedent of the petitioner Nos.1 and 2 is clean whereas petitioner Nos. 3 and 4 have one criminal antecedent in which they are on bail. He further submits that both parties are resident of same village and neighbour and due to land dispute, the scuffling took place from both sides and injury has been caused to both sides.
6. Counsel further submits that petitioners undertake that such mistake shall not occur in future.
7. Learned APP for the State opposes the prayer for bail of the petitioners and submits that petitioner Nos.1 and 2 have clean antecedent whereas petitioner Nos. 3 and 4 have one criminal antecedent

8. As such, in the present facts and circumstances of this case, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) each as mentioned in Section 2(1)(d) of the BNSS, 2023 to the satisfaction of C.J.M., Gopalganj, in connection with Gopalganj Town P.S. Case No. 797 of 2024, subject to the conditions as laid down U/s 482(2) of the BNSS, 2023.
