====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 26-06-2018 Heard Sri Karandeep Kumar, learned counsel for the petitioner and Sri Binod Kumar, learned Additional Public Prosecutor.

The sole petitioner, apprehending his arrest in connection with Kotwa P.S. Case No. 48 of 2018, registered for the offence punishable under Sections 272, 273 of the Indian Penal Code , 1860 and Section 30(a) and 37(b) of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail in the event of his arrest or surrender.

Learned counsel for the petitioner at the very outset has argued that petitioner is having clean antecedent and in this case recovery of huge quantity of Indian make foreign liquor was shown which was buried in an abundant hut . It has been argued that petitioner was not having any connection with the

Patna High Court Cr.Misc. No.32430 of 2018(3) dt.26-06-2018 2/2 said hut.

However, after going through the F.I.R. it is evident that information was received to Police that in the newly constructed hut of the petitioner huge quantity of liquor was concealed and thereafter search was conducted and recovery was affected.

I do not find any ground to grant anticipatory bail to the petitioner.
