JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 24-10-2019 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Pothia P.S. Case No. 151 of 2018, registered for the offence punishable under Sections 304(B), 201 and 34 of the Indian Penal Code.

As per prosecution case, daughter of the informant was married with Mohan Devnath Singh @ Mohan Devnath (petitioner) one year ago. After marriage, all the accused persons were demanding dowry. Due to non-fulfillment of demand of dowry, informant's daughter was done to death by the accused persons including this petitioner and her dead-body was found lying in the bank of river.

It is submitted by learned counsel appearing on behalf of petitioner that petitioner is innocent. Petitioner is in custody

Patna High Court CR. MISC. No.47290 of 2019(5) dt.24-10-2019 2/2 since 29.05.2019 having clean antecedent.

From perusal of postmortem report, it appears that there were ante-mortem injuries caused by hard and blunt substance on the person of the deceased.

Considering the facts aforesaid and the fact that petitioner is husband of the deceased, I am not inclined to enlarge the petitioner above-named on bail. Accordingly, the same is rejected.
