Petitioner seeks bail in a case registered for the offences punishable under Sections 363, 365, 328, 379, 376,120-B of the Indian Penal Code.
Allegation against the petitioner is that he kidnapped to the wife and minor daughter of the informant. Both have already appeared and statement of wife was recorded under Section 164 Cr.P.C. vide Annexure-2. The statement of the victim would reveal that wife of the petitioner was also involved in the kidnapping of the victim and later on the petitioner took her to Haryana and was in physical relation with her. Later on the
Patna High Court Cr.Misc. No.33239 of 2018 (2) dt.26-06-2018 2/2 petitioner dropped the victim to Patna and left her. Submission is that the matter is of love affairs between the two and just to pressurize false case has been lodged. The petitioner is in custody since 21.12.2017. Learned counsel for the Informant opposed the prayer for bail, however, does not dispute that wife of the informant as well as the minor child is safe in the custody of the family of the informant.
In the circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Ramkrishna Nagar P.S. Case No.323 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
