JUSTICE SHIVAJI PANDEY ORAL ORDER 31-07-2019 Heard learned counsel for the petitioners, learned counsel for the State and learned counsel for the informant. In this case, the petitioners are seeking anticipatory bail in connection with Gobardhana P.S. Case No.26 of 2019, registered for the offence punishable under Sections 147, 148, 149, 323, 341, 324, 307, 427, 504, 506 of the Indian Penal Code and subsequently added Section 302 of the Indian Penal Code. In the FIR, there is specific allegation of assault made against the present petitioners to cause several injuries on the body of the victim.
Looking to the nature of allegation, this Court is
Patna High Court CR. MISC. No.47520 of 2019(2) dt.31-07-2019 2/2 not inclined to grant bail to the petitioners. Accordingly, the prayer for bail is rejected. However, if the petitioners surrender before the Court below within four weeks from today and pray for regular bail, the Court below will consider the same and pass appropriate order without being influenced by the order of this Court.
