Petitioner seeks regular bail in connection with Budhuchak P.S. Case No. 63 of 2019 registered for the offence under Section 341 / 323 / 324 / 379 / 504 / 34 of the I.P.C. The allegation as per the First Information Report is that the petitioner along with other accused persons surrounded the informant and one of the accused Sumit Kumar gave knife blow on the stomach of the informant and the petitioner along with other accused persons allegedly pointed pistol towards the informant and threatened him of dire consequences. Learned counsel for the petitioner submits that petitioner has not committed any offence in the manner alleged , both the parties are agnates and due to previous enmity the petitioner has been dragged in the present case. Learned counsel next submits that petitioner has got no criminal antecedent and

Patna High Court CR. MISC. No.6284 of 2021(2) dt.15-04-2021 2/2 from perusal of the First Information Report it would be evident that the co-accused /Sumit Kumar has given knife blow to the informant and the only allegation against the petitioner is that he pointed pistol towards the informant.

Having regard to the submissions made by the learned counsel for the parties and taking into consideration the materials available on record, the nature of allegation against the petitioner, the fact that both the parties are agnates and the petitioner is in custody since 03.09.2020 having no criminal antecedent, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. XIIIth, Bhagalpur in connection with Budhuchak P.S. Case No. 63 of 2019.

It is made clear that at the time of furnishing bail bond all the parties shall follow the guidelines regarding social distancing.
