JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 11-04-2016 Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner apprehends his arrest in connection with Complaint Case No. 402 (C )/2014 registered for the offences punishable under Sections 366 (A) of the I.P.C. The accusation is of kidnapping of the daughter of the complainant Meera Devi by the petitioner. It is alleged that the petitioner performed marriage with victim Laxmi Kumari at Railway Station Mandir and left her at Sultanganj from where she came to her house.
Learned counsel appearing on behalf of the petitioner submits that in fact there was love affair between the petitioner and daughter of the complainant and both wanted to perform marriage
Patna High Court Cr.Misc. No.9577 of 2016 (2) dt.11-04-2016 2/2 and a statement of the victim was recorded under Section 164 of the Cr. P. C. in which she also admitted about the marriage of her own sweet will and also express her desire to live with the petitioner.
Further submission is that at the time of recording the statement under Section 164 of the Cr. P.C. in which she has stated her age about 18 years and learned Magistrate has also assessed her age to be 18 years.
Having considered the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender within a period of six weeks from today before the Court below be enlarged on bail on furnishing bail bonds of Rs, 10,000/- ( ten thousand only) with two sureties of the like amount each to the satisfaction of learned Mr. Naresh Mahto, learned Judicial Magistrate, 1st class, Munger in connection with Complaint Case No. 402 ( C )/ 2014, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
