The petitioner apprehends his arrest in connection with Nautan P.S. Case No. 279 of 2021 registered under Section 30(a) of the Bihar Prohibition and Excise Act. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Further he submits that the sugar cane field from where the alleged recovery has been made is situated about 500 meters away from the house of this petitioner. The sugar cane field does not belong to the petitioner. Petitioner has no criminal antecedent.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the

Patna High Court CR. MISC. No.60535 of 2021(2) dt.15-04-2022 2/2 event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of Special Judge (Excise), Bettiah, West Champaran in connection with Nautan P.S. Case No. 279 of 2021, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
