JUSTICE RAKESH KUMAR ORAL ORDER 14-06-2018 Heard Sri Manoj Kumar Singh, learned counsel for the petitioner and learned Additional Public Prosecutor. The sole petitioner, having clean antecedent , which fact has been stated in paragraph no. 3 of the petition , apprehending his arrest in connection with Teghra P.S. Case No. 88 of 2018, registered for the offence under Section 30(a)/ 37(b) of the Bihar Prohibition and Excise Act, 2016 , has prayed for grant bail in the event of his arrest or surrender. Learned counsel for the petitioner submits that only on suspicion as well as village politics petitioner has been made accused in the present case. He submits that in the case recovery of 10.8 liters of Indian make foreign liquor was shown from outside a scrap shop which was belonging to one Pramod Singh. It has been argued that owner of the shop was arrested

Patna High Court Cr.Misc. No.33224 of 2018(2) dt.14-06-2018 2/2 and petitioner's name has come as if some of the villagers disclosed that petitioner was the owner of the scrap shop. It has also been argued that nothing has been indicated regarding which villager disclosed the name of the petitioner. In a vague manner petitioner has been made accused.

Be that as it may, considering the nature of accusation and clean antecedent of the petitioner, in the event of his arrest or surrender within a period of six weeks from today, let the petitioner - Shankar Singh be enlarged on bail on furnishing bail bond of Rs. 10,000/- ( rupees ten thousand ) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge - II cum Special Judge Excise, Begusarai / concerned court in connection with Teghra P.S. Case No. 88 of 2018 subject to the conditions as contemplated under Section 438 (2) of the Code of Criminal Procedure, 1973. (Rakesh Kumar, J) praful/- U T
