Petitioner seeks bail in Sasaram(M) P.S.Case No. 145 of 2018 registered for the offences punishable under Sections 307, 324/34 of the Indian Penal Code and Section 27 of the Arms Act.
As per prosecution case, while the informant was standing near the shop of his Fuwa at about 9 pm on 3.09.2018 all the two F.I.R named accused including three unknown persons came on motorcycle and after some hot talk they resorted to firing as a result, the informant sustained gun shot injuries on his back.
There is general and omnibus allegation of firing. No
Patna High Court CR. MISC. No.60348 of 2021(2) dt.10-02-2022 2/2 specific role has been attributed to this petitioner. As per F.I.R itself, informant could not see whose firing hit him. Petitioner is in custody since 11.06.2021.Investigation is complete Considering the aforesaid facts and circumstances as well as period of detention of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram in connection with Sasaram ( M) P.S. Case No. 145 of 2018.
