Earlier also the petitioner defaulted in appearance. The writ application has been filed for restoring the shop/Gumti to the petitioner who was running his business as a cobbler in the Gumti (wooden kiosk).

The State-respondent has pointed out that with the consent of the shopkeeper(s) and others the Gumtis/kiosks were removed and pucca construction was made and thereafter applications were invited wherein the petitioner also applied. The shop was not allotted to him on various grounds.
