The petitioner is languishing in custody since 21.04.2019 in a case for the offence registered under Sections 420, 406 and 120(B) of the IPC.
The prosecution story, in brief, is that on 03.10.2017 Lalit Kumar Chaudhary said the informant that he has one Mobile Number being No. 9507285611 which does the business of doubling the notes. He contacted on the said Mobile. Then he was asked to come at Khutauna Bazar and thereafter at Madhepur and he told his name as Deepak. The informant and Lalit Kumar Chaudhary went there. Thereafter, one person came there and he took them to Shiv Kumar Ram and one unknown person. The informant was advised by Shiv Kumar Ram to
Patna High Court CR. MISC. No.49557 of 2019(2) dt.08-08-2019 2/3 arrange Rs. 50,000/- and it was said that Rs. 2,00,000/- will be given to him. Later on, the informant gave him such amount. It is further alleged that after few days, co-accused Shiv Kumar Ram again asked him to bring an amount of Rs. 1,00,000/- for which he will be given Rs. 10,00,000/- and he further conveyed the informant that if he fails to bring such amount then he will loose Rs. 50,000/- also. Thereafter, the informant gave him Rs. 1,00,000/- also and whereupon co-accused Shiv Kumar Ram handed him over a packet stating that this packet contained the said amount of Rs. 10,00,000/- and left, but the informant found that in the said packet, upper and lower layer was of proper notes and the rest were scrap papers.
It has been submitted by learned counsel for the petitioner that the petitioner has got no criminal antecedent. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. The petitioner has falsely been implicated in the present case. There is no document in respect of transaction of money. No specific overt act is alleged against this petitioner. Other co-accused has been granted bail by another Co-ordinate Bench of this Court vide Cr. Misc. No. 4560 of 2019 under order dated 29.01.2019.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. Jhanjharpur, Madhubani, in connection with Laukaha P.S. Case No. 228 of 2017, corresponding to G.R. No. 1490 of 2017. (Sudhir Singh, J) U.K./- U T
