2. The petitioner has preferred this application for grant of regular bail in connection with G.B. Nagar P.S. Case No. 127 of 2025 dated 31.03.2025 registered for the offences punishable under Sections 333, 74, 75, 76, 351(2), 352 read with Section 3/5 of the B.N.S. and Sections 8, 12 and 17 of POCSO Act.

3. As per the prosecution case, the informant alleged that the petitioner crossed the boundary wall and entered her house and pointed pistol in sleeping condition and started

No.49685 of 2025(2) dt.19-08-2025 2/3 teasing and tried to do wrong, further, the petitioner clicked picture when she was sleeping, thereafter, when she opposed, the petitioner assaulted and threatened her to kill and snatched her mobile phone. It is further alleged that the petitioner surrounded her younger brother and threatened him not to lodge a case and threatened to face dire consequence.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the possession of the petitioner. The occurrence took place on 28.03.2025 but the FIR was lodged on 31.03.2025 i.e. the delay of three days and there is no explanation for this delay. Learned counsel has further submitted that there is nothing on record which shows that the victim was forced to have illicit relationship with another person. The petitioner has no concern with the alleged occurrence. The petitioner has one criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 21.04.2025.

5. Learned A.P.P. for the State has opposed the bail petition of the petitioner and submitted that the victim is minor.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner above-

No.49685 of 2025(2) dt.19-08-2025 3/3 named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Siwan in connection with G.B. Nagar P.S. Case No. 127 of 2025, with a condition:- (i) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner are liable to be cancelled.
