JUSTICE DINESH KUMAR SINGH ORAL ORDER 31-05-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 149, 332, 186, 153, 201, 353, 504 of the Indian Penal Code. The prosecution case is that on 21.11.2014 at 5:30 P.M the informant being SHO of Kurtha P.S on information being received with regard to a dead body lying in the paddy field, proceeded on the spot and wanted to send the dead body for autopsy but petitioner along with 30-35 villagers came and obstructed the informant to perform the official duty. The accused persons also tried to set the police jeep on fire. It is submitted by learned counsel for the petitioner that accusation is against the mob and people were protesting against the inaction of the police, hence the police, in order to save its skin lodged the case with frivolous accusation.

Considering the accusation against the mob, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks

Patna High Court Cr.Misc. No.24498 of 2016 (2) dt.31-05-2016 2/2 from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Arwal in connection with Kurtha P.S. Case No. 173 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
