The petitioner has filed the instant application for grant of regular bail in connection with Pratapganj P.S. Case no. 88 of 2020 registered under sections 392 and 34 of the Indian Penal Code.

As per allegation in the FIR, it is stated by the informant that four accused persons on two motorcycles, on threat of arms dispossessed the informant of his belongings including the vehicle, Rs. 70,500/- in cash, a mobile phone, etc. It is submitted by learned counsel for the petitioner that the FIR was registered against four unknown. No incriminating article has been recovered from his possession and he has not been put on T.I. parade. He is in custody since 6.7.2020 and has no criminal antecedent. The application for bail is opposed by learned Additional Public Prosecutor for the State.

Having heard learned counsel for the parties and taking into consideration the fact that the petitioner has not been put on T.I. parade and charge-sheet has been submitted in the case together with the period in custody, the Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Pratapganj P.S. Case no. 88 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Birpur, Supaul.
