JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 12-04-2016 Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioner is apprehending his arrest in connection with Chandi P.S.Case No. 03/2016 registered for the offences punishable under Sections 341, 323, 379, 504/34 of the I.P.C.

The accusation is that the informant being the official of Indus End Bank, Jail Road, Ara and his associate Arish Kumar went to the Village- Narahi for relegation of installment from Kumari Ragni in respect to loan taken for purchase of vehicle Tata Safari. On demanding the installment amount, both were taken by Prem Ranjan Kumar husband of Kumari Ragini in orchard. After some time Kumari Ragini, her father-in-law and four unknown persons came and abused and assaulted them and snatched Rs. 03, 35,000/- and non -Judicial Stamp of Rs. 1000/-

Patna High Court Cr.Misc. No.9664 of 2016 (2) dt.12-04-2016 2/2 from bag. Thereafter Prem Ranjan Kumar asked him not to lodge the case and he would pay the money till 4-5 January, 2015 but he did not pay the installment.

Learned Counsel appearing on behalf of the petitioner submits that it appears from F.I.R. that occurrence is said to be of 28.12.2015 but the F.I.R. is lodged on 06.01.2016 giving explanation of delay in lodging the case to the effect that the petitioner asked not to lodge the case with assurance to give money but he did not pay money. In fact, the present case has been lodged by the Bank Officials only to give pressure to return the loan amount very soon.

Under the facts and circumstances, let the petitioner, above named in the event of his arrest or surrender within a period of six weeks from today before the Court below be enlarged on bail on furnishing bail bonds of Rs, 10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur, Ara in connection with Chandi P.S.Case No. 03/2016, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
