Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The Petitioner is apprehending his arrest in a case registered for the offences punishable u/s 419, 420, 467, 468 of the Indian Penal Code.
As per the prosecution case, the co-accused Himanshu Kumar was caught giving examination in third sitting on behalf of the petitioner in the Railway Recruitment Board Group 'D' Examination.
Learned counsel for the petitioner has submitted that
Patna High Court CR. MISC. No.50745 of 2022(2) dt.09-01-2023 2/2 the petitioner has falsely been implicated in this case due to ulterior motive of the informant. The petitioner did not appear in the said examination. The petitioner is quiet innocent. The petitioner has no criminal antecedent as stated at para 3 of the bail petition.
Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
Considering the aforesaid facts and circumstances as well as the material available in the case diary, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 20,000/- (Rupees Twenty thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Purnia in connection with Purnea Sadar P.S. Case No. 535 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This application stands allowed.
