JUSTICE PARTHA SARTHY ORAL ORDER 22-06-2021 Heard learned counsel for the petitioner and learned A.P.P for the State through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Special Case no.93 of 2019 arising out of Kankarbagh P.S. Case no.500 of 2019 registered under section 354B of the Indian Penal Code and sections 4 and 8 of the POCSO Act.
As per allegation in the F.I.R., it is stated by the informant that she has three children. On returning home it transpired that her husband who is a drunkard had sexually abused the minor children.
It is submitted by learned counsel for the petitioner that the allegations as levelled in the F.I.R. are false and
Patna High Court CR. MISC. No.6610 of 2021(3) dt.22-06-2021 2/2 concocted. The petitioner has been falsely implicated in the case. The informant has lodged the instant case because of matrimonial dispute. The petitioner is in custody since 25.9.2020 and charge has been framed in the case on 15.10.2020.
The application for bail is opposed by learned A.P.P. for the State.
Having heard learned counsel for the parties and taking into consideration the direct allegation against the petitioner of having sexually abused his own minor children, this Court is not inclined to enlarge the petitioner on bail and the application is rejected.
