The petitioner has filed the instant application for grant of regular bail in connection with Bhagwanpur P.S. Case No. 254 of 2014 registered under Sections 365 and 366 of the Indian Penal Code.
As per allegation in the FIR, while the informant's wife went outside for nature's call, petitioner along with unknown co-accused kidnapped her for illegal purpose. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. He has falsely been implicated in this present case. It is further submitted that it is not a case of kidnapping rather false case has been instituted against the petitioner because during exhibition
Patna High Court CR. MISC. No.50738 of 2022(3) dt.12-01-2023 2/2 of circus, the informant and his in-laws family members used to demand ransom for exhibiting circus in his village and nonfulfillment of their demand, they lodged this false case against the petitioner. It is further submitted that the victim stated in her statement recorded under Section 164 of Cr.P.C., that petitioner along with unknown co-accused did not commit any wrong with her. Petitioner is languishing in judicial custody since 11.06.2022.
The application for bail is opposed by learned APP for the State.
Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Bhagwanpur P.S. Case No. 254 of 2014 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M-I, Hajipur.
