JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-03-2016 Heard learned counsels for the petitioners and the State. The petitioners being brother-in-law, sisters and mother of husband of informant are apprehending arrest in a case registered for the offences punishable under Section 341, 323, 498A, 497 of the Indian Penal Code and under section 3⁄4 of Dowry Prohibition Act.
The prosecution case is that the informant is married with Vikrant Rajvansh but thereafter torture was inflicted to her for non-fulfillment of dowry demand. It is alleged that petitioner Nos.2 and 3 used to reside in the house of husband of informant
Patna High Court Cr.Misc. No.10435 of 2016 (2) dt.02-03-2016 2/2 and they also inflicted torture to the informant. It is submitted by the learned counsel for the petitioners that petitioners No.2 and 3 are married sisters of the husband of informant and they reside at different places but accusation has been levelled simply because they happen to be sisters of the husband of informant. Petitioner No.4 is old mother-in-law of the informant and she has no concern with the husband of informant. Considering the aforesaid facts and the fact that thrust of accusation is against the husband of informant, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Siwan in connection with Siwan (Muffasil) Mahadewa O.P. P.S. Case No. 329 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
