1. Heard the parties.
2. The petitioners apprehend their arrest in connection with Bagaha P.S. Case No. 90 of 2025 dated 30.03.2025 registered under Sections 126(2), 115(2), 118(1), 117(2), 352, 351 (2), 109, 3(5) of the Bhartiya Nyaya Sanhita 2023.
3. As per the F.I.R. on 26.03.2025 in the afternoon the
2/4 co-accused : Rahul Dom, Bitu Dom and Lalu Dom came at the informant's house and threatened informant's sister-in-law Soni Devi to withdraw the case of murder of her daughter or else they would kill her. At about 8:00 P.M. in the same evening when the informant and her family members were having meal in the courtyard the petitioners alongwith other accused persons arrived there and petitioner no. 3 / Manjit Ram assaulted informant's brother Kundan Ram with Khar. Mahesh Kumar and Toofani Ram stabbed him with knife at his back and badly injured him. Pramod Ram attacked him with lathi. The petitioner no. 1 gave lathi blow to the informant's brother and petitioner no. 2 assaulted on the leg of the informant. In the meanwhile the petitioner no. 6 - Lalu Dom along with Sadhu Dom badly injured the informant's son namely Pinnu Kumar.

Learned counsel for the petitioners submits that petitioners have falsely been implicated in this case due to previous dispute regarding murder of the informant's daughter in which the co-accused Rahul Dom and Bitu Dom were falsely implicated and the petitioners and others had arrived for talk in the meanwhile both the parties started assaulting each other for which a counter case has been lodged by the side of the petitioners having Bagaha P.S. Case No. 91 of 2025. Referring
3/4 to the impugned order learned counsel submits that only Kundan Ram has sustained injury due to sharp cut weapon and as per the F.I.R. the assault is attributed to petitioner no. 3 / Manjit Ram. Other victims have sustained simple injury.

Regard being had to the submission made by the parties, taking into consideration the nature of allegation against the petitioner no. 3 (Manjit Ram) that he assaulted with sharp cut object to the informant's brother -Kundan Ram and he sustained grievous injury, I am not inclined to grant anticipatory bail to the petitioner no. 3. The same is rejected.
6. Insofar the allegation against the remaining petitioners is concerned, the victims have sustained simple injury and case and counter case is there due to previous enmity , accordingly, I am inclined to grant anticipatory bail to the petitioner no. 1, 2, 4, 5 & 6 .
7. Let the petitioner no. 1, 2, 4, 5 & 6, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-1st , Bagaha, West Champaran in connection with Bagaha P.S. Case No. 90 of
4/4 2025 subject to the condition as laid down under Section 482 (2) of the B.N.S.S. 2023.
