The petitioners seek bail in anticipation of their arrest in connection with Govindpur P.S. Case No. 131 of 2019, dated 23.07.2019, instituted for the offences under Sections 302, 147, 148 and 149 of the Indian Penal Code and Section 3/4 of the Prevention of Witch Craft (Dayan)
Patna High Court CR. MISC. No.6839 of 2021(2) dt.14-12-2021 2/3 Practices Act.
The petitioners and eleven others are said to have entered the house of the deceased and killed her on the charge of her having practiced witchcraft on a deceased boy some times ago.
So far as the act of assault is concerned, it is attributed to Suresh Manjhi and Naro Manjhi.
The petitioners, it has been argued, are only said to be the members of the mob.
Aforesaid Suresh Manjhi and Naro Manjhi have been granted regular bail by a Bench of this Court vide order dated 24.08.2020 passed in Cr. Misc. No. 18941 of 2020. The other accused persons of this case have been granted anticipatory bail by different Benches of this Court, one being vide order dated 05.01.2021 passed in Cr. Misc. No. 30089 of 2020.
The petitioners are not attributed with any specific role, either of branding the deceased as a person practicing witchcraft or of having assaulted her.
Regard being had to the facts afore-stated, the
Patna High Court CR. MISC. No.6839 of 2021(2) dt.14-12-2021 3/3 petitioners, in the event of their arrest or surrender before the learned Court below within a period of four weeks, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Govindpur P.S. Case No. 131 of 2019, subject to the conditions laid down under Section 438(2) of the Cr.P.C. The application stands allowed.
