Petitioner being Panchayat Mukhiya is apprehending his arrest in a case registered for the offences punishable under Sections 406, 409, 420, 467, 468, 471/34 of the I.P.C.
Accusation is of conferring benefits to dead persons under different government schemes.
It is submitted by learned counsel for the petitioner that payments were received by the heirs of the dead persons. Moreover the Panchayat Sewak has been granted bail vide Cr. Misc. No. 35770 of 2014 on readiness to deposit fifty percent of the alleged defalcated amount of Rs. 40,125/-. The petitioner is also ready to deposit fifty percent of the defalcated amount i.e. Rs. 20,063/- which will be invested in some fixed deposit scheme in connection with the
Patna High Court Cr.Misc. No.9169 of 2015 (2) dt.04-03-2015 2/2 present case which will be subject to the result of the case. On deposit of the aforesaid amount, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhubani in connection with Harlakhi P.S. Case No. 48 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
