Petitioner is in custody in connection with Special Case No. 1717 of 2018 arising out of Pirbahore P.S. Case No. 101 of 2018 for the offenses punishable under section 30(a) of Bihar Excise Act.
The learned counsel for the petitioner submits that the petitioner has no criminal antecedent. He was driving the vehicle carrying liquor seized by the police. Learned counsel for the petitioner submits that he was not aware of the loaded liquor. As per the direction of owner of pick up van, he was plying the pick up van to deliver the goods loaded on the van to its destination. Learned counsel submits that in the totality of

No.33504 of 2018(2) dt.05-06-2018 2/2 the situation when the petitioner was not aware of the consignment loaded in the vehicle in question and is not owner of the vehicle and the liquor, petitioner deserves bail. Considering the fact the petitioner is in custody since 25.02.2018 and he has no criminal antecedent, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise Act at Patna, in connection with Special Case No. 1717 of 2018 arising out of Pirbahore P.S Case No. 101 of 2018.
