2. The grievance of the petitioner is only in respect of release of seized three mobile phones, arising out of Excise Matter.

3. The Superintendent of Police, Banka has directed his sub-ordinate official to release the subject matter of mobiles.

4. In view of the aforementioned development, the present petition do not survive for consideration. The concerned authority, who is in possession of petitioner's mobile phones, is hereby directed to hand over the same to the petitioner or owner of those mobiles within a period of 3 days from today. If the concerned authority fails to release the mobiles, in that event, he is hereby directed to pay litigation cost and it is quantified at Rs. 25,000/-. Copy of this order be furnished to the State counsel to enable the concerned officer to implement the aforementioned direction.
