JUSTICE DINESH KUMAR SINGH ORAL ORDER 14-03-2016 Petitioners being parents of the husband of the victim are apprehending their arrest in a case registered for the offences punishable under Sections 304B, 201/34 of the Indian Penal Code.
The accusation is of killing the daughter of the informant for non-fulfilment of dowry demand. It is submitted by learned counsel for the petitioners that as per the own admission of the informant that marriage was performed in 2007 when the victim died in 2015, the case does not come within the purview of Section 304B I.P.C. The petitioners claim to be separate from the husband of the victim and the accusation is omnibus and general against the petitioners.
Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or
Patna High Court Cr.Misc. No.10705 of 2016 (2) dt.14-03-2016 2/2 surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Ekma P.S. Case No. 172 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
