JUSTICE ASHUTOSH KUMAR ORAL ORDER 29-06-2018 Heard the learned counsel for the petitioners, informant and the State.
The petitioners seek bail in anticipation of their arrest in connection with Piprahi P.S. Case No. 77 of 2017, dated 29.05.2017, instituted for the offences punishable under Sections 147, 341, 342, 323, 324 and 307 of the Indian Penal Code.
The petitioners and others are said to have assaulted the informant. Petitioner No. 1 is said to have used
Patna High Court Cr.Misc. No.32774 of 2018 (3) dt.29-06-2018 2/2 a bamboo stick, whereby he hit the informant on his right hand finger, leading to injuries. Similarly, petitioner No. 2 is said to have assaulted the informant on his leg. The grievous injury on the person of the informant has been authored by one Rajesh Rai. There is counter version of the occurrence as well, though, of course, lodged after two days of the occurrence.
Learned counsel for the petitioners has submitted that some of accused persons of this case have been granted anticipatory bail by a Bench of this Court vide order dated 18.01.2018, passed in Cr. Misc. No. 1935 of 2018. Considering the aforesaid facts as well also that the petitioners do not have any criminal antecedent, let the petitioners, above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, be released on bail on their furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheohar in connection with Piprahi P.S.
